Please read these Terms of Service carefully before using Experal. By creating an account or using our marketplace, you agree to be bound by these terms.
1. About Experal
Experal is a global multi-vendor marketplace that connects independent sellers with buyers worldwide. We provide the platform, payment infrastructure, and discovery tools — sellers operate their own storefronts and are responsible for the products they list and the orders they fulfil.
2. Account Registration
To buy or sell on Experal, you must create an account. You agree to:
- Provide accurate, complete, and up-to-date information
- Keep your login credentials secure and confidential
- Accept responsibility for all activity that occurs under your account
- Promptly notify us of any unauthorised use of your account
You must be at least 18 years old to create an account. Accounts created on behalf of a business must be registered by an authorised representative.
3. Seller Terms
3.1 Seller Eligibility
To sell on Experal, you must complete our seller onboarding process, which includes verifying your identity and connecting a Stripe account for payouts. By listing products, you confirm that you have the legal right to sell them.
3.2 Listing Standards
Sellers are responsible for ensuring all product listings are:
- Accurate and not misleading — titles, descriptions, images, and attributes must reflect the actual product
- Priced correctly, including applicable taxes for the buyer's jurisdiction
- In stock and available to ship within the stated timeframe
- Compliant with all applicable laws in both the seller's country and the buyer's country
Experal reserves the right to remove listings that violate these standards without prior notice.
3.3 Prohibited Items
You may not list or sell:
- Counterfeit, replica, or unauthorised branded goods
- Hazardous materials or items banned for cross-border shipment
- Stolen goods or items obtained through unlawful means
- Any item whose sale is restricted or prohibited under applicable law
3.4 Order Fulfilment
Sellers must fulfil orders within the handling time stated on their storefront. You are responsible for accurate shipping costs, proper packaging, and providing valid tracking information where available.
3.5 Marketplace Commission
Experal charges a commission on each completed sale. Current commission rates are shown in your seller dashboard and may be updated with 30 days' notice. Payouts are processed weekly via Stripe to your connected bank account.
4. Buyer Terms
4.1 Purchases
By placing an order, you agree to pay the listed price plus any applicable shipping costs and taxes. Payments are processed securely via Stripe. Experal displays prices in your local currency using live exchange rates — the final charge will be in the currency you select at checkout.
4.2 Returns and Refunds
Return and refund eligibility is determined by the individual seller's policy, which will be displayed on their storefront and at checkout. Where a seller fails to fulfil an order or the product is materially different from its listing, you may raise a dispute through Experal and we will mediate on your behalf.
4.3 Disputes
If you have an issue with an order, please first contact the seller directly through your order dashboard. If the issue is not resolved within 5 business days, you may escalate it to Experal support. We aim to resolve all disputes within 10 business days of escalation.
5. Prohibited Conduct
All users of Experal agree not to:
- Use the platform for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Circumvent Experal's payment systems by transacting off-platform
- Scrape, crawl, or harvest data from Experal without written permission
- Attempt to gain unauthorised access to any part of the platform
- Post content that infringes intellectual property rights or is offensive, threatening, or defamatory
6. Intellectual Property
6.1 Experal's IP
The Experal platform, branding, and all associated software are owned by Experal and protected by applicable intellectual property laws.
6.2 Your Content
You retain ownership of content you submit (product images, descriptions, etc.). By submitting content, you grant Experal a worldwide, non-exclusive, royalty-free licence to display, reproduce, and distribute your content solely for the purpose of operating and promoting the marketplace.
7. Payments and Currency
All payments on Experal are processed by Stripe. Experal supports multiple currencies and uses live foreign exchange rates to convert prices at checkout. Sellers receive payouts in their configured payout currency. Experal is not responsible for exchange rate fluctuations between the time of listing and the time of sale.
8. Limitation of Liability
Experal acts as an intermediary marketplace and is not party to transactions between buyers and sellers. To the maximum extent permitted by law, Experal's total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the greater of (a) the fees paid by you to Experal in the 12 months preceding the claim, or (b) £100.
Experal is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, or business interruption.
9. Indemnification
You agree to indemnify and hold Experal harmless from any claims, losses, damages, and expenses (including reasonable legal fees) arising from:
- Your use of the platform
- Products you list or sell
- Your violation of these terms
- Your violation of any third-party rights
10. Termination
Either party may terminate an account at any time. Experal may suspend or terminate accounts immediately if we determine you have breached these terms, engaged in fraudulent activity, or pose a risk to other users. On termination, your right to access the platform ceases and outstanding balances will be settled according to normal payout schedules where applicable.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 30 days before changes take effect. Continued use of Experal after the effective date constitutes acceptance of the revised terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
